Shaynen.com operates exclusively as an online-only store.

2. Definitions

  • Entrepreneur: MOTIME Distribution, trading as Shaynen.com
  • Consumer: a natural person acting outside their trade, business, or profession
  • Agreement: the purchase agreement concluded between the Entrepreneur and the Consumer via the webshop

3. Applicability

These General Terms & Conditions apply to all offers, orders, and agreements concluded via the webshop.

By placing an order, the Consumer confirms acceptance of these Terms & Conditions.

Deviations from these terms are valid only if expressly agreed in writing.

4. Offer & product information

The presentation of products in the webshop constitutes a non-binding online catalogue and does not represent a legally binding offer.

All products offered are:

  • original branded products
  • lawfully sourced within the European Economic Area (EEA)
  • sold by Shaynen.com as an independent reseller

Shaynen.com is not an official brand store nor an authorized dealer, unless explicitly stated.

Obvious errors, pricing mistakes, or typographical inaccuracies do not bind the Entrepreneur.

5. Conclusion of the agreement

An Agreement is concluded when:

  • the Consumer places an order by clicking the “Buy” button, and
  • the order is confirmed by email or the goods are dispatched.

Order confirmations are sent to the email address provided by the Consumer.

6. Prices

All prices are stated in euros and include VAT, unless stated otherwise.

Shipping costs are not included in the product price and are displayed separately during checkout.

7. Payment

Payment must be made in advance using one of the available payment methods.

Available payment methods may include:

  • iDEAL
  • Credit card (Visa / Mastercard)
  • PayPal
  • Klarna (consumers only)
  • Bank transfer (pre-payment)

Orders are processed only after full payment has been received.

Until full payment has been made, the goods remain the property of the Entrepreneur.

8. Delivery & fulfilment

Delivery takes place at the address provided by the Consumer.

Orders are fulfilled either by Shaynen.com or directly by one of its logistics or supplier partners.

Delivery times are estimates and depend on destination, carrier performance, and external circumstances. Delays caused by third parties do not entitle the Consumer to compensation, unless required by law.

9. Shipping options & Transfer of risk

Available shipping options and costs are displayed during checkout.

  • Insured shipping: risk of loss or damage remains with the Entrepreneur until delivery
  • Uninsured shipping: risk transfers to the Consumer once the shipment is handed over to the carrier
  • By selecting uninsured shipping, the Consumer accepts this allocation of risk.

10. Right of withdrawal (Returns)

The Consumer has the right to withdraw from the Agreement within 14 days without giving any reason.

The withdrawal period expires 14 days after the day the Consumer (or a third party designated by the Consumer) receives the goods.

To exercise the right of withdrawal, the Consumer must notify Shaynen.com via a clear statement (e.g. email).

Returned goods must be:

  • unused
  • undamaged
  • returned in original or equivalent protective packaging

The Consumer bears the direct cost of returning the goods.

11. Refunds

After receipt and inspection of the returned goods, refunds will be issued within 14 days using the original payment method.

Standard delivery costs are refunded only if the entire order is returned.

Additional costs for express or premium shipping options are not refunded.

If returned goods show signs of use or damage, a reduction in the refund amount may apply.

12. Warranty & defects

All products are covered by statutory consumer warranty rights.

Warranty period

  • 2 years from the date of delivery

Burden of proof

  • First 6 months (NL / EN) or 12 months (DE): defect presumed to have existed at delivery
  • After this period: the Consumer must demonstrate that the defect was not caused by misuse

Warranty does not cover damage caused by:

  • improper use
  • impact or dropping
  • water damage due to incorrect handling
  • normal wear and tear
  • unauthorized repairs or modifications

Depending on the situation, repair or replacement will be offered where reasonable.

13. Transport damage

If goods arrive with visible transport damage, the Consumer must:

  • report this to the carrier immediately
  • notify Shaynen.com within 3 calendar days

This does not affect statutory consumer rights.

14. Liability

The Entrepreneur is not liable for:

  • indirect or consequential damages
  • damages caused by improper or unintended use of the product

Statutory liability cannot be excluded.

15. Set-off & retention

The Consumer may only offset claims that are undisputed or legally established.

A right of retention may only be exercised for claims arising from the same Agreement.

16. Battery disposal notice

Where products contain batteries, Consumers are legally obliged to return used batteries.

Used batteries may be returned free of charge to:

  • municipal collection points
  • retailers
  • or our dispatch warehouse

Batteries must not be disposed of with household waste.

17. Governing law & jurisdiction

All Agreements are governed exclusively by Dutch law.

For merchants, the place of jurisdiction and performance is Amsterdam, The Netherlands.

18. Severability clause

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions remain in full force.

The invalid provision shall be replaced by the applicable statutory provision.
